General Sales conditions

In this document you will find the General sales and on-line payment conditions to be carried out through the website corresponding to domain; www.bygrecostore.com ("Website") owned and managed by 'Greco S.r.l.', with register office in Via F. Di Palma, 61 Taranto,VAT nr and Fiscal Code: 03208280739.

Apart from any possible derogations to be specifically agreed upon in writing, such general conditions ("General conditions") regulate the realtionships between Greco S.r.l. and the customers, consumers or professionals ("Customer").

Contract conclusion

    1. The contract drawn up by 'Greco S.r.l.' and the Customer shall be considered as concluded upon order acceptance by 'Greco S.r.l.' and, in any case, if the payment has been carried out successfully. By placing an order online, the Customer declares he has viewed all the instructions received during the purchasing process and also he accepts all General Conditions as reported below.
    2. Once an online purchasing process is completed, the Customer shall print or save an electronic copy of the same and in any case he shall save these General conditions. Should the Customer be a Consumer, he shall do it by complying with the provisions of articles 52 and 53 of Leg. Decree dated September 6, 2005 nr. 206 ("D.Lgs. n. 206/2005").

Purchase options

    1. The Customer can purchase online only those items present in the electronic catalogue published on the website ("Products") and indicated as available upon forwarding the order, according to the descriptions reported in the relevant information sheets accessible online. It is understood that sizes, weighs, dimensions and performance reported in the information sheets express approximate values and the pictures each information sheet is equipped with cannot represent the item's characterics properly; for example, they can differ as to colours, sizes, components and/or accessories.
    2. The order receipt is confirmed by 'Greco S.r.l.' which shall send an e-mail message to the e-mail address indicated by the Customer upon registration in the reserved website access area or upon filling in the electronic form relating to the order transmission. Such confirmation message shall report the order receipt date and time and a "Customer Order Number" which shall have to be used for any further message exchange with Greco S.r.l. Greco S.r.l. reply message shall contain a summary of the placed order as well as all Customer's details. The Customer shall check if they are correct and, in case of errors, communicate any possible corrections in due time, according to the modalities reported in the same message.
    3. If, for any reason, Greco S.r.l. could not execute the Customer's order, the former shall inform the latter by e-mail.

Compensation

    1. The compensation for the Products purchase shall be communicated from time to time by 'Greco S.r.l.' to the Customer through the same website and its total ampunt shall be summarized in the cart.

The compensation payment shall be carried out by the Customer according to one of the following options.

Payment options

    1. The payment for the Products purchased online by the Customer shall be carried out according to the options chosen upon order process. The Customer shall only pay the total amount reported upon conclusion of the purchasing process. In case of acceptance of orders placed from outside the Italian country, the amount corresponding to the price of the ordered Products shall be quit of charges which shall be exclusively paid by the Customer.
    2. The payments for the Products purchased according to this General Conditions shall be carried out exclusively by credit card, bank transfer or PayPal card (www.paypal.it). 

      8.1 Credit cards
      • In case of Products purchased by credit card, upon conclusion of the online purchasing process, the relevant bank shall authorize exclusively the amount corresponding to the purchase carried out by the Customer. The amount corresponding to the purchased goods, even partially, shall be charged on the Customer's credit card only upon notice (sent to Greco S.r.l. by means of the selected Courier) of the successful delivery of the ordered Product. 
        In case of lack of notice by the courier or in case the notice were not necessary according to special delivery options, being unable to check the exact delivery date of the ordered Product, Greco S.r.l. shall have the faculty to charge the relevant amount on the Customer's credit card on the day following the delivery of the Product or Products ordered by the Customer.
      • In case of Customer's withdrawal, according to Leg. Decree nr. 206/2005, or in case of order refusal by 'Greco S.r.l.', the latter shall immediately request the annulment of the transaction and the release of the amount in question. The release time, for special types of cards, depend exclusively on the bank system and can extend to its natural expiry (currently, 24 days after the authorization date).
      • Greco S.r.l. reserves the faculty to charge the amount of the Customer's order on the latter's credit card, in order to avoid the expiry of transaction authorization as provided for in the previous paragraph (b).
      • Greco S.r.l. reserves the faculty to request the Customer additional information (for ex. Phone number) or the transmission of a copy set of documents proving the legal ownership of the credit card used by the Customer. The latter shall take note that, should he not send the requested documents, the order could not be accepted.
      • During the purchasing process, Greco S.r.l. cannot access the information concerning the Customer's credit card which have been transmitted by the latter by means of protected direct connection to the website of the Bank managing the transaction. No electronic file belonging to Greco S.r.l. can save such information. Therefore Greco S.r.l. shall not be considered as liable in case of fraudulent or illegal use of credit cards by third parties upon payment of Products purchased on the Website.
      • In Case the Customer carried out the payment by credit card, Greco S.r.l. cannot be considered as liable of transaction results, which exclusively depend on the third party providing online payment service. Furthermore the transaction itself shall be selected among the main national sector operators.
      • The Customer accepts that the forwarding of a puchase order as well as the compensation payment shall be carried out by means of telecommunication nets or service whose correct functioning is outside the sphere of action of 'Greco S.r.l.' which therefore cannot be considered as liable for it.

      8.2 Bank transfer
      • In case the payment of Products is carried out by bank transfer, the Customer's order confirmation (to be sent by e-mail to Greco S.r.l. according to what is stated in the above article 4) shall contain the bank coordinates of Greco S.r.l. In this case the Products ordered by the Customer shall be set aside until the transfer of the corresponding amount is carried out on Greco S.r.l. account.
      • In any case, the Customer shall send a copy of the transfer order carried out in favour of Greco S.r.l. by fax to nr. +39 099 4529293 or by e-mail to the following address: servizioclienti@bygrecostore.com, after latest 48 hours since the order confirmation receipt. Should the receipt of the bank transfer copy not arrive within the above mentioned deadline of 48 hours, By Greco shall annul the Customer's order.
      • The delivery of the Customer's order shall be carried out, once Greco S.r.l. will receive the actual credit amount concerning the order on its own account.

      8.3 Payment by PayPal
      • In case the selected payment option is by PayPal, the Customer will be able to carry out the order payment directly thorough his own verified PayPal account. By Greco informs it will accept only payments carried out by verified accounts and reserves the right to deliver the Products ordered by the Customer to the address reported on the verified PayPal account.
      • Order payments coming from non-verified PayPal accounts shall be annulled and, as a consequence, not executed by 'Greco S.r.l.'

      8.4 Payment by Cash on Delivery (only in Italian)
      • Another method of payment offered by BYGRECOSTORE.COM is the "COD (Cash on Delivery)" with fixed charge of 5,00 Euro and only for orders not exceeding 500 Eur, paying with cash only. In case the shipment of an order placed with COD did not succeed for reasons attributable to the customer, BYGRECOSTORE.com reserves the right to take no action to any other order with the same method of payment. The service is available in Italy only. The customers which choose to pay cash on delivery must have a bank account in case of refund for returning products.

Delivery options and costs - Invoicing

  1. The ordered Products shall be sent to the address reported by the Customer upon registration in the Website access reserved area or, if different, to the address reported on the relevant order. 
    The delivery status of the order shall be visible to the Customer by accessing the Website and consulting the area reserved to the purchase history.
  2. For each order carried out on the Website, Greco S.r.l. shall issue invoice of the delivered Products, by both sending it to the order adressee's e-mail address (according to art. 14 Presidential Decree 445/2000) and including five copies of it in the package containing the Products. As regards the invoice issue and preparation, the information given by the Customer on the order form upon registration in the Website access reserved area shall be taken into account. Once the invoice is issued, it will no longer be possible to modify the entered data.
  3. The delivery costs, as shown on the Website as well as on the order text, shall be paid by the Customer, unless there are special promotions expressly indicated on the website.

    1. The orders delivery shall be carried out from Mondays to Fridays. The orders forwarded on Saturdays or Sundays or on any other holidays or days before a holiday shall be processed by 'Greco S.r.l. on the first working day after the order placement date.
    2. The delivery of the ordered Products to the Customer shal be carried out by a duly appointed courier. The Notice to the Customer about the Courier appointed for the delivery shall be carried out according to the modalities provided for on the Website. No liability shall be addressed to Greco S.r.l. in case of delivery delays.
    3. The Customer will be able to verify the delivery status of his own orders at any time, by accessing the Website reserved area or the link to the selected Courier's website, by matching the "Customer Order number" received upon order confirmation and "Track Change Number" (or the like) assigned to each single delivery.
    4. Greco S.r.l. conctract performance towards the Customer shall be considered as fulfilled in the place where the Products purchased by the latter are delivered by 'Greco S.r.l.' to the appointed courier. 
      The delivery of the ordered Product carried out by the courier shall be considered at the Customer's street level.
    5. Upon delivery of the purchased Product by the courier, the Customer shall verify:
      • if the number of delivered items corresponds to what is reported in the dispatch note sent in advance by e-mail.
      • that the package and the sealing materials (such as adhesive tape) are left undamaged, dry or unaltered.
      Should the packaging and/or the Product be damaged or in case the number of items or the relevant order information were lacking, such problems shall be claimed immediately by the Customer by writing SUBJECT TO VERIFICATION (and specifying the reason, for ex. "pierced packaging" or "crushed packaging", etc.) on the courier dispatch note. Once the latter has been signed, the Customer shall not raise any claim againt the external characteristics of the delivered goods. 
      Any possible problems concerning the physical integrity, as well as the correspondence and the completeness of the received Products shall be signalled within 30 days since the verification day, according to the modalities provided for in these General Conditions.
    6. In case of non-collection within 5 working days of the unclaimed Product from the courier warehouse, due to the latter impossibility to deliver it to the address reported by the Customer upon order placement, the ordered Product shall be returned to Greco S.r.l. warehouse.

Withdrawal right

    1. According to art. 64 of Leg. Decr. Nr. 206/2005, if the Customer is a consumer he has the right to withdraw from the purchase contract for any reason, without being obliged to give any explanations or being subject to any penalties, according to the terms and modalities reported in the following paragraphs.
    2. In order to exercise the withdrawal right according to the above mentioned art. 18, the Customer shall send Greco S.r.l. a notice within 14 working days since the receipt date of the Products to which the withdrawal right is exercised. Such notice shall be sent by e-mail to: resi@bygrecostore.com or by the relevant form available on the Website.
    3. Once the above mentioned withdrawsl notice has arrived, the Customer will soon receive instructions about the return modalities by being assigned an univocal RMA (Return Merchandise Authorization) code for the Product/s return. The Product to be returned shall be sent back to Greco S.r.l. within 7 days since the notice receipt of the above mentioned RMA. To this purpose, it will be taken into due consideration the delivery date reported by the post office or the forwarding agent.
    4. The purchased Product shall be returned undamaged, unused, unwashed or unaltered; it shall be complete in all its parts, equipped with its relevant safety sealing and left untouched inside its orginal packaging (including original wrapping and boxes and any possible accessory materials, such as dustbags, coat hangers and clothes covers). In order to limit any possible damage to its original packagin, we recommend to put it in another box, upon which a label reporting the RMA number (return authorization code) shall be applied; in any case, it is strictly forbidden to apply any label on the product original packaging.
    5. The delivery costs concerning the Product return shall be paid by the Customer; the latter shall not be refunded any delivery costs nor any possible accessory costs. 
      The delivery shall be on the Customer's own responsibility until the Products returns to Greco S.r.l. warehouse.
    6. The withdrawal right shall be applied exclusively to the Products purchased in its entirety; it is not possible to exercise withdrawl to only one or more parts of the purchased Product. In case of orders including more than one Product, it shall be possible to exercise the withdrawl right to one or more ordered Products by specifying the description of the Products to be returned on the withdrawl notice, according to the above mentioned art. 19. 
      Should the Product be damaged during transportation, Greco S.r.l. shall inform the Customer (within 5 working days since the Products arrival in its own warehouse), in order to allow him to opportunely take action against the Courier or carrier he selected and therefore be refunded the total value of the Product (if insured); in this case, the Product shall be placed to the Customer's disposal for its return and at the same time the withdrawl claim shall be annulled. 
      Greco S.r.l. is not liable for any damage or theft/loss of the Product. 
      On its arrival at Greco S.r.l. warehouse, the Product shall be subject to inspection in order to estimate any possible damages or pilfering not depending on the transportation. Should the original packagin or wrapping be damaged, Greco S.r.l. shall keep a percentage of the refund due to the Customer, which shall not exceed 10% of the the same Product value as a contribution to the repair costs.
    7. Without prejudice to the repair costs for damages verified on the original packaging, Greco S.r.l. shall refund the Customer the amount paid by the latter for the purchase of the Product within 14 day since its return. In case of payment carried out by credit card, this will occur by transaction cancellation concerning the amount charged to the credit card or by bank transfer. In the latter's case, the Customer shall promptly provide the bank coordinates to which the refund shall be addressed (ABI-CAB-IBAN codes - Account number and name of the Bank of the Invoice addresse). 
      In case the payment options chosen by the Customer were cash on delivery by bank cheque whose amount has not been collected by 'Greco S.r.l.' yet, the latter shall return the Customer the bank cheque subject to refund of the repair costs, if due. On the contrary, if the relevant cheque had already been collected by 'Greco S.r.l.', the latter shall refund the Customer's paid amount, excluding any possible repair costs, by means of bank transfer to the coordinates reported by the Customer according to the above mentioned terms.
    8. The Customer shall not have the right to excercise his withdrawal right in case of lack of the primary condition of the Product integrity (packaging and/or its content), should Greco S.r.l. verify:
      • the use, even partial, of the Product and any possible accessories;
      • the lack of the original external packaging and/or internal wrapping;
      • the lack of parts integrating the Product;
      • the lack of the guarantee sealing applied to the Product;
      • the damage to the Product due to causes not depending on its transportation.

Guarantee

    1. All products sold on the Website are covered by the manufacturer's guarantee in case of non-conformity for a period of 12 months in case the Customer is a professional man/woman (an as such, holder of a VAT number) or for a period of 24 months in case the Customer is a consumer, as provided for by Leg. Decree nr. 206/2005.
    2. The manufacturer's guarantee is granted according to the law.
    3. The guarantee is applied to the Product showing non-conformities, provided that the same Product has been used properly by respecting its functions and according to what is provided for in the attached domcuments. In case of non-conformity, Greco S.r.l. shall restore the Product's conformity at his own expenses, by repairing/replacing or reducing the item's price or annulling the contract. Should the defect, after an inspection carried out by 'Greco S.r.l.', not belong to a non-conformity, the Customer shall be charged of any possibile inspection and repair costs, if applicable, as well as the transportations costs if born by 'Greco S.r.l.'.
    4. In case Greco S.r.l., for any reason, could not grant its Customer a Product covered by guarantee (repaired or replaced), By Greco S.r.l shall decide whether refunding the amount paid by the Customer, by considering the Product use, or by replacing the Product with another one having similar or better properties.
    5. The time for repair or for any possibile replacement of the defective Product depend exclusively on the Manufacturer's plicy and no damage shall be ascribed to Greco S.r.l. in case of delay due to repairs or replacement operations.
    6. Should the application of the guarantee provide for the return of the product, the Customer shall return it in its original packaging, complete in all its parts (including wrapping and any possible documents or accessories). In order to limit damage to the original packaging, Greco S.r.l. suggests the Customer to place it inside another box.

Information privacy

    1. According to art. 13, Leg. Decree 196/2003 as amended, Greco S.r.l., as the person in charge of the personal data processing, informs the Customer that all personal information supplied by the latter and contextually acquired by the former (i) during the registration in the Website reserved access area, (ii) at the end of any Product purchase contract drawn up online on the Website, (iii) when navigating the Website by the so-called system "log", shall be used by 'Greco S.r.l.' by means of manual, computerized and telecommunications means for the following purposes:
      1. carrying out those activities necessary to the conclusion, management and execution of contracts concerning the purchase of products on the website;
      2. for purposes strictly related and/or necessary to the fulfillment of the requests from time to time presented by the user on the Website or by e-mail or by any other communication means;
      3. for purposes related to the obligations provided for by laws, regulations and by EU provision as well as provisions ordered by legitimate authorities or Supervisory boards;
      4. sending newslettes and advertising materials concerning the service offered by 'Greco S.r.l.'

With reference to the above mentioned purposes, Greco S.r.l. informs that the transmission of data is compulsory as to the purposes indicated in 1), 2) and 3); consequently, in such cases, in case of data transmission refusal, Greco S.r.l. will not be able to satisfy and execute the Customers orders or requests.

In consideration of what stated above, with reference to the data processing as per paragrapgh 4), Greco S.r.l. will ask from time to time the user to give his own consent to such processing by means of suitable forms on the Website.

The processing of personal data is carried out with a logic strictly concerning the purposes in question and, however, in order to guarantee the safety and the privacy of the data themselves. Besides, the personal data shall be communicated - for the purposes stated at points 1), 2) and 3) - to companies different from Greco S.r.l. which shall process independently as persons in charge for the data processing. In any case, the personal data shall not be subject to circulation.

All data shall be stored inside EU.

Finally, Greco S.r.l. informs that art. 7, Leg. Decree. 196/2003 grants special rights to the users providing their own personal data. In particular, users can get the confirmation of the existence of their own data from the owner or the relevant person in charge; users have also the right to have such data at their own disposal in a comprehensible way. The interested parties can also request the origins of the data as well as the logic and purposes regulating the processing; they can also ask for the cancellation, the transformation into anonymous or the stoppage of the processed data in case of law infringement as well as the updating, the modification or, if desired, the integration of the data; finally, they can reject the same processing due to legitimate reasons.

In order to be informed about amendments or modifications to the policies concerning information privacy carried out by 'Greco S.r.l.' due especially to regulations modifications, it is necessary that users constantly refer to this document.

Applicable law

    1. The General Conditions contained herewith are exclusively regulated by the Italian Law.

I AGREE

Pursuant to and in accordance with art. 1341 and 1342 of the Civil Code, I herewith declare I expressly agree with the provisions as to the following General Conditions articles contained in this document: 3 (brief description of the Products present in the catalogue); 5 (faculty not to execute the order); 8.1, lett. e (non-liability in case successful online payment); 8.2., lett. b (reservation of order cancellation in case of lack of bank transfer notice within 48 hours deadline); 8.3, lett. b (reservation of order cancellation in case of payments coming from unverified PayPal accounts); 11 and 22 (delivery/shipment costs and dues to be paid by the Customer); 15 (compliance with Greco S.r.l. obligations upon the delivery of the Product to the appointed courier); 16 (Customer's duty to verify the delivered Products); 17 (Customer's acceptation of the Product without reservations, in case of claim's lack); 23 (reservation of 10% charge in case of damage to the returned Product); 15 (reservation of refusal of returned Products); 32 (privacy) and 34 (applicable law).
